How Much Is My Back Injury Worth?

December 9th, 2009

Different personal injury settlements are worth different
amounts. There are many reasons for this.

There are infinitely many different ways a person can injure
himself and they all have a different sort of impact on the
life of the victim. There is no set value that a back injury
settlement is worth, but one can predict higher or lower values
when taking a few things into consideration:

The severity of the injury A back injury is a
soft-tissue injury, and therefore, is more difficult to observe
the effects of than that of a broken bone.

The characteristics of the injured party If the
victim is young and attractive, a disfiguring injury is going
to be worth more than it would be on someone older and/or
homelier.

The age of the victim A permanent or long-time injury
to a child is always going to net more than one sustained by an
adult. Children are more vulnerable.

The type of job the victim does A manual laborer is
more easily incapacitated from his work than someone with a
more sedentary job, and therefore, his injury is going to be
worth more.

How often a person claims he or she is
injured
If a person has a history of claiming an
injury, especially a soft-tissue injury, the likelihood of a
large settlement is going to be a lot less.

There are a lot of other factors that will influence your
claim that are separate from you, some of which are:

** Your attorney’s reputation If your attorney is well known
by the insurance companies as very experienced and competent at
proving cases like yours, then the insurance companies will be
more apt to place a better offer

** Your doctor’s reputation. If you choose a doctor that
specializes only in patients filing personal injury cases, then
it is very likely that your doctor will be notorious in the
courts and you will be awarded less money as you will be
suspected of fraud.

** The extent of property damage that was caused. If more
damage was done to your automobile or other property in the
accident, then your injury is more likely to be seen with
credulity by the jury.

** The amount of time you are unable to work.

** How long you and your attorney are willing to wait until
the maximum amount is offered.

Don’t Suffer The Pain Of An Injury Caused By An Accident

October 25th, 2009

There are many different types of injuries you might
accidentally be involved in and many different places these
accidents may occur. People make mistakes and accidents
happen.

You can be accidentally injured at the workplace, at home,
in a motor vehicle, or participating an almost any activity. A
very common type of accident that leads to injury is a motor
vehicle accident. Many people crash their vehicles daily. This
can be due to many different factors such as if the driver over
corrects during a skid and crashes, a driver is drunk and hits
another driver or objects on or near the road, or even if the
driver falls asleep.

You can claim compensation for pain and suffering caused by
an injury if it can be proved that the accident was caused by
someone else acting negligently.

The workplace may contain many different hazards that might
lead to an accidental injury. Many people work in high risk
jobs where they are around dangerous materials such as
explosives, chemicals, and heavy objects. It can take something
as simple as a misplaced cord that someone trips over to cause
an accidental injury. Many employers have a contract all
employees must agree to before they get the job. This contract
is usually signed after the employee is trained in all safety
procedures and company policies. The safety procedures vary
from job to job and usually give the employee specific rules
they should always follow to maintain the safest work
environment possible. When safety procedures aren’t followed,
it could lead to injury or even death and the employer might be
held liable.

Accidents that lead to injury might occur in public places
as well such as a park, supermarket, or retail store. Some
employees that work in these places might not follow the safety
procedures and stack things irregularly, not maintain their
equipment properly, or just have an unsafe environment that
customers might come into contact with. A good example of this
is the classic wet floor. If an employee mops something up and
doesn’t put up signs, a customer may slip and injure
themselves. In cases like these, the business can be liable for
damages and a lengthy court process.

The best way to avoid accidents that lead to injury is to
follow all the procedures you know to keep yourself out of
harms way. If you see something in a public area that looks
hazardous, don’t go near it and notify someone in charge of
that area to handle it properly. If you are at your workplace
and see safety procedures not being followed or implemented
incorrectly, notify a supervisor who can handle the problem or
possibly change the safety procedures to benefit everyone. Just
know what to do when you see anything that looks unsafe and
take the proper measures to ensure it is remedied as quickly as
possible.

Preventing Infant Head Trauma

September 10th, 2009

Inflicted, non-accidental head injuries are the leading
cause of traumatic death in infants. An infant should be
monitored constantly and not left alone on any surface where
there is a potential that they can roll or crawl off of it. A
fall of 5 feet is more than enough to create an impact that
will lead to traumatic brain injury.

Shaken baby syndrome is all too common in the media. There
are constant stories about caregivers, parents, and family
members being accused of shaking their babies which leads to
brain damage and death. When a baby is shaken, a whiplash
motion is set into effect. This creates what is known as an
acceleration-deceleration injury which can cause terrible
injuries in an infant or young child. Shaken baby syndrome can
happen in children up to five years of age but is usually seen
in infants and toddlers. Most cases are in infants under 1
years of age. Even shaking a baby for just a few seconds can
produce the effects of shaken baby syndrome. The main injuries
which occurs result from the acceleration of the shaking and
the deceleration of the baby’s head hitting an object – even a
pillow or cushion. The inside of the skull is not smooth and
the brain will bounce around being bruised and scraped. The
whiplash effect is very harmful in infants and toddlers because
their heads are very large and heavy and their neck muscles and
ligaments are not very developed.

Falls are impossible to control but there are many steps to
ensure your child is not harmed when falling. If you have an
infant, once they are able to roll and crawl around, make sure
you only let them do so in a well controlled and safe
environment. A well cleaned large floor area or outside in the
grass are some of the safest places as long as the grassy area
is free of rocks. If you have stairs, make sure to use a baby
gate so your child doesn’t tumble down them. Never leave your
child unattended on a couch or other furniture as they can (and
will) roll off of it as soon as you leave the room.

Head injuries in babies are largely preventable. Common ways
a baby will sustain infant head injuries include: motor vehicle
accidents, shaken baby syndrome, and rolling off beds, couches
or other furniture. Motor vehicle accidents are impossible to
predict so all you can do is ensure your child is in a rear
facing car seat that is properly fastened. Shaken baby syndrome
is 100% preventable however. If you, or a friend, is having
difficulties with an infant or toddler, see if a relative will
watch them for a while or just put them in their crib and walk
away until you are under control.

Am I Entitled To An Injury Settlement?

July 27th, 2009

In short, if you can prove that you have been injured or
contracted a disease as a result of another party’s neglegance,
then you are entitled to an injury settlement. But you have to
be able to prove that the other party is at fault.

There are many different types of personal injury claims, so
you should be aware of what type of claim you want to file.

Usually you are allowed to file a claim for a personal
injury settlement for up to three years after the accident
occurs. The rules are different, however, if you have
contracted an industrial disease, or if you were a child when
the injury occurred. For example, if you were injured at birth
as a result of the hospital’s neglegance, then you could file a
claim against that hospital as an adult and receive
compensation for that injury.

Normally you don’t even need to appear in court to file a
personal injury claim. If you did, this would lead to higher
costs paid out by the neglegent party or the neglegent party’s
insurance company. Most businesses and insurance companies
would prefer not to be forced to cover the extra legal fees
this would bring about, so, unless the defendant has a solid
reason to doubt their guilt, then they are most likely to
settle out of court. There is no set standard for the amount
that will be awardeed to any specific injury. Every case is
different and the amount of compensation you receive will
depend on the affect your injury has on your situation as an
individual.

You may end up receiving an interim payment plan before your
case is actually settled. This means that the guilty party has
not yet decided exactly how much they are responsible to cover
in your situation and so they will pay out for your
rehabilitation, modified equipment, or medical treatment until
they decide the total amount they owe you due to your
injury.

Achieving a personal injury settlement should not be a
difficult task and most attorneys will be happy to work with
you to fight for your rights in such a claim. Many will
understand that you are injured and agree to conduct business
over the phone or by e-mail. After all, their business is to
work for you and help you to get exactly what you deserve.

Diminished Cognitive Functions And Brain Injury

June 12th, 2009

On some occasions, a head injury may lead to one of many
different forms of memory loss or diminished cognitive
functions. Many people immediately think of amnesia, which does
happen, but there are other common and not so common forms of
memory loss associated with brain injuries.

Because the brain is such a complex thing, it must be
treated delicately. Since it is securely enclosed inside the
skull, many people think the brain is protected against most
minor accidents. This is not so. Even a mild case of whiplash
can result in long term traumatic brain injury.

A common area associated with a mild brain injury caused by
head trauma involves the development of concentration and
attention disorders. This can be very hard to diagnose and
tends to be noticed by family members and close friends more
often than not. Someone who used to be able to sit down and
build a model airplane for hours now only plays a Nintendo
GameBoy in 5 to 30 minute bursts instead. Once properly
diagnosed, the person who received this injury can acquire the
proper treatment to help them live a normal life and usually
they are just as happy as before. People don’t tend to
categorize attention and concentration with memory but it ties
in very closely to short term memory. If you are trying to read
a book while constantly interrupted and can’t focus clearly on
what you are reading, you are probably experiencing a short
term memory loss. After a spinal cord injury, some people might
experience this type of memory loss – often referred to as head
injury dizziness – for a period of a few days or even the rest
of their lives.

Amnesia can occur from many different events. Whether
something penetrates the skull and damages a memory region of
the brain, or if the brain suffers a contusion that comes from
a concussion, whiplash, or car accident head injury it’s a
possibility a person may have some form of amnesia. Amnesia is
a total loss of memories from a certain time period. The most
common is a few days before and after the head injury but in
rare cases can wipe out a person’s entire memory and cause them
to revert to a state similar to infancy. They will need to
learn to walk and talk all over again and may never be the same
person they used to be. This is very rare however. Amnesia is
portrayed in the media and is the type of memory loss most
people think of as a consequence of head injury rather than
something more benign such as elderly memory loss.

There are many specific areas of the brain that effect
memory and if any of them are damaged or bruised, there is a
potential to have some form of aspartame memory loss. The best
way to prevent memory loss due to head injury is to try to be
safe in your daily activities. Wear a helmet when rock
climbing, or using any type of transportation and drive the
safest vehicle possible that is equipped with multiple airbags.
Vehicle accidents are the leading cause of memory loss due to
head injury.

How To Get The Most From Your Injury Lawyer

April 28th, 2009

An injury attorney specializes in cases that have to do with
injuries a person sustains at work, home, or pretty much
anywhere. An injury lawyer is a much better choice than a
regular attorney because they have a great deal of experience
with injury cases and are more familiar with those particular
laws.

An injury law specialist can determine who is liable,
appropriate compensation, and an appropriate payout to
compensate for pain and suffering caused by the injury.

If you are injured at work and you have been following all
of the proper safety procedures, you might not receive
everything you should through your employers insurance.
Depending on the type of injury, it can be very expensive for
medical treatments, prescriptions, and time missed from work.
Severe injuries might make you permanently disabled as well.
Insurance companies have many complicated laws that someone who
is not trained in law might not be able to fully understand. If
you are injured in any way, it’s always best to consult an
attorney. There are many factors you should consider when
looking for an injury lawyer.

Price is always a large factor when picking an attorney.
Many people don’t have the funds to get expensive legal advice
and as the case develops and you meet with that attorney, the
hours can add up quickly. Many law professionals follow a
policy where they will not charge you unless you win your case.
This is good as it usually doesn’t require a down payment. If
your attorney doesn’t get paid unless you win, they are usually
very motivated and focused on your case and can determine
quickly if your case is even worth pursuing. You need to make
sure you understand what percentage the lawyer will receive or
if you will be charged the hourly rate after the case is over.
If you are not careful, you might end up with very little while
the attorney makes a fortune. There are usually extra fees as
well – if you are going to have to pay for your professional
legal team performing mundane tasks such as accessing records,
make sure you agree to the professional fee and it is properly
explained.

Attorneys with the most experience are better equipped to
handle your case than an inexperienced attorney. The legal
professional you choose should have a great familiarity with
insurance and trials. A lawyer who has dealt with insurance
companies before will be able to negotiate a better settlement
for you. Many cases are resolved before actually going to court
- these are known as “out of court settlements”. If your case
does go to court, you want to make sure your attorney has
plenty of litigation experience.

If you start to have doubts about your attorney, you can
always find a new one. A good respectful attorney will call you
regularly themselves and update you on your case progress. If
you call them, they should return your call in a timely
fashion.

Protect Yourself From Brain Injury At All Times

March 14th, 2009

The brain is protected by a hard shell called the skull. The
brain is vulnerable even with the skull protecting it.

The consistency of the brain is like jello. It is so soft
that it is very easy to cause damage to it. One strong jolt to
the brain can bring about permanent damage. There are many ways
by which one can get traumatic brain injury. The more popular
causes for brain injury are vehicular accidents, sports
injuries and falls.

Accidents can never be prevented. But there are ways to
lessen the chances of brain injury from happening to you. Some
professions, such as football players and racing or motorcycle
drivers, are more prone to brain injury than any other
professions. That is why they are required to wear a helmet to
protect their heads from sudden impacts. It tends to stabilize
the head during motion which is the reason why some people who
have been involved in a car accident walk away as if nothing
had happened from them.

All it takes is a few seconds so take precaution because the
effects of brain injury are unpredictable. It can affect the
way you think, how you move, how you speak and sometimes how
you feel. It may differ from person to person. The brain injury
will depend on the severity of the blow, and the location of
impact to the brain. Some never recover from the injury. Others
have but to a limited extent only. So take care of your brain
before brain injury changes the rest of your life.

Frontal Lobe Damage Causes And Its Effects

January 28th, 2009

Damage to the frontal lobe can be devastating because that’s
where our emotional center is.

It is where our personality comes from. It can affect our
motor function, problem solving skills, spontaneity, memory,
language, initiation, judgment, impulse control, social and
sexual behavior. The frontal lobes define who we are. It is
extremely vulnerable to danger because of its location. Studies
have shown that it is the most common area that receives mild
to traumatic brain injury.

You can determine for yourself if a person has received
frontal lobe damage by checking out the pronounced dramatic
change to his or her social behavior. This usually happens when
both lobes are affected. A person can get it if there is
extreme impact done on the head with that of another object.
The brain slams itself against the walls of the skull during
the impact. You can also get it if there loss of oxygen to the
brain which usually happens during a stroke or during
suffocation. Another indication that there is frontal lobe
damage if there is loss of consciousness and loss of
memory.

Treatment to frontal lobe damage depends on the severity of
the damage. For less threatening cases, a surgeon may prescribe
medicine. A person would have to undergo through a couple of x
rays to look for abnormalities. X rays are followed by a biopsy
if there is a need to. The results and the analysis will give
the doctor a better point-of-view to determine how severe the
damage is.

A Happier And Healthier Brain With Deep Brain Stimulation Techniques

December 14th, 2008

The brain is a muscle and it can atrophy if you don’t take
good care of it. This includes proper exercise and nutrition.
Sufferers from traumatic injuries to the brain can benefit from
the following good habits in order to maintain maximum
performance of their remaining healthy gray matter:

Eat Breakfast! People with lower blood sugar levels
are sending less nutrients to their brains and this can cause
brain degeneration. You’re not just feeding your body when you
eat, you’re feeding your brain as well!

Don’t Overeat! Overeating causes hardening of the
arteries in the brain, weakening it’s ability to function.

Don’t Smoke! Smoking causes shrinkage in the brain
and some studies have suggested that smoking can even lead to
Alzheimer’s disease.

Don’t Eat Too Much Sugar! High sugar levels cause
difficulty in the way the body absorbs nutrients and can lead
to malnutrition and lack of nutrients sent to the brain. Feed
your brain good things like fish, fruits, and vegetables.

Breathe Clean Air!  Polluted air may not provide
enough oxygen to the brain, which is the organ that consumes it
most. Our brains need nice, clean air to stay healthy, just
like our lungs do.

Sleep! Your brain needs to rest. Sleep deprivation
causes the death of brain cells. So just let yourself fall
asleep and you’ll gain more than you would have if you stayed
up doing whatever it was that you thought was more important
than your brain.

Don’t Sleep With Your Head Covered Sleeping with your
head covered is a bad idea because it prevents oxygen from
getting to your brain.

Don’t Work When You’re Sick! Putting yourself through
stress in the form of working or studying while you are ill can
cause brain damage. If you exert yourself while you’re sick,
you’re only going to make things worse.

Think Stimulating Thoughts! Like any other muscle,
our brains need exercise to be healthy and strong. Think deep
and stimulating thoughts on a regular basis or engage in
challenging puzzles to keep yourself thinking.

Talk! Conversations and debates will keep your brain
chugging along.

If you permanently incorporate these habits into your
lifestyle your brain will be happier and healthier. Our brains
are our most valuable organ and when we take care of our
brains, our whole body benefits.

How Competent Is Your Accident Injury Lawyer?

October 30th, 2008

With the dramatic rise of personal injury cases in the U.S.
over the past couple of decades, many law firms are claiming to
employ competent accident injury lawyers. But with the scads of
firms that are out there nowadays, one must be cautious about
who one chooses to fight for his rights in such a case.

It is vitally important for an injured party to be as
educated as possible in selecting a lawyer to represent their
case because the lawyer is the person who will be advocating
for the injured party and trying to get as much just
compensation as possible for any damages caused by the injury.
They have to be expert in every aspect of this area of the law
in order to achieve maximum benefits. A serious injury can have
catastrophic affects on many aspects of a person’s life. It can
hurt financially, psychologically, as well as physically and
emotionally. A good lawyer will be able to ferret out every
corner of the compensation that may be attained.

Here are a few things one can do in order to find a
competent accident injury attorney:

Search the web for databases that handle these types of
lawyers. It will be obvious which ones are displaying quality
attorneys over those that favor ones buying a load of
advertising space.

If you already have a good lawyer specializing in a
different field, he or she may be helpful in your search, as he
or she is more than likely associated with other trustworthy
attorneys of separate fields of concentration.

Investigate your local bar association. They will be able
and willing to give you the skinny on any attorney you choose.
They may also be able to recommend some competent and
trustworthy attorneys.

Use the attorneys references to get an idea of his or her
level of experience and success in personal injury claims.

Go with your gut. If an attorney makes you feel
uncomfortable or uneasy, don’t trust him or her with your case.
There may be reasons you are understanding unconsciously not to
trust the person.

A lot of competent and trustworthy accident injury attorneys
exist and want to cover your injury cases. And there are also a
few who may be inexperienced or may try to take unfair
advantage of an injured party. But they should be easy enough
to avoid if you are educated.
